Welcome to Sasha Nord.

These Terms of Service govern your access to and use of the Sasha Nord website, products and services, including purchases made through our online store.

By placing an order, you agree to the terms applicable to your purchase. Please read them carefully before completing your purchase.

1. Business Information

Sasha Nord is a Norwegian design and lifestyle brand operated by SASHA NORD BIRLAN, a registered Norwegian sole proprietorship (ENK).

Throughout these Terms of Service, "Sasha Nord", "we", "us" and "our" refer to SASHA NORD BIRLAN.

"You" and "your" refer to customers and visitors using our website and services.

Our online store is powered by Shopify.

2. Products and Services

Sasha Nord offers design-led products, including personalised pet portraits, artwork and selected home and lifestyle goods.

Certain products are custom-made according to information supplied by customers, including photographs, names, colours, sizes and other personalisation preferences.

We make reasonable efforts to display product images, colours, dimensions, materials and descriptions accurately.

However, minor differences may occur due to screen settings, printing methods, materials and the handmade or individually produced nature of certain products.

Such differences do not affect your legal rights where a product fails to conform to its description or the purchase agreement.

Product availability, designs and specifications may change. Changes will not affect confirmed orders without an appropriate legal or contractual basis.

3. Orders and Acceptance

By placing an order, you confirm that:

• The information you provide is accurate and complete.

• You are legally capable of entering into a purchase agreement.

• You have the necessary rights or permissions to provide any photographs or other material submitted for personalisation.

• You have reviewed the product details, personalisation choices and total price before purchasing.

After placing an order, you will receive an order confirmation by email.

An order confirmation acknowledges your purchase. We may contact you if additional information is required to fulfil the order.

If an order cannot be fulfilled because of an error, unavailable product or another legitimate reason, we will inform you and provide the refund or other remedy required by applicable law.

We will not make material changes to confirmed orders without your agreement or another lawful basis.

4. Custom Artwork and Personalisation

Personalised pet portraits are created individually from photographs and instructions provided by customers.

Customers are responsible for submitting photographs of sufficient quality and providing accurate personalisation details.

Sasha Nord may contact customers to request clearer photographs or additional information where necessary.

We aim to preserve the recognisable features, expressions and character of each pet while applying our own artistic interpretation.

Because artistic work involves creative judgment, the final design may differ in style or detail from the original photograph.

However, the finished product must conform to its description, the agreed specifications and applicable consumer law.

5. Artwork Adjustments and Redesigns

We understand that customers may wish to make adjustments to their personalised artwork.

Minor adjustments

Reasonable minor changes may be made without additional charge, subject to the stage of production and technical feasibility.

Minor adjustments may include small corrections to artistic details, colours or composition that remain within the scope of the original order.

Complimentary redesign

Sasha Nord offers one complimentary artwork redesign per personalised portrait order if the customer is dissatisfied with the artistic result.

The complimentary redesign is limited to the original product specifications and does not automatically include changes to the number of pets, product dimensions or other substantial order characteristics.

Changes after production begins

Requests to modify an order after production has begun are subject to our approval.

Substantial changes may involve additional costs, particularly if new artwork, printing or materials are required.

Any additional charges will be communicated to the customer and must be approved before they are incurred.

We will not impose additional fees for voluntary changes without the customer's agreement.

These voluntary adjustment and redesign provisions do not limit statutory rights concerning defective or non-conforming products. Necessary remedies for such products remain available in accordance with applicable law.

6. Customer-Submitted Photographs and Materials

When uploading or submitting photographs, text or other materials to Sasha Nord, you confirm that you own the relevant rights or have obtained the necessary permissions for their use.

You agree not to submit material that unlawfully infringes another person's intellectual property, privacy or other legal rights.

By submitting material for an order, you grant Sasha Nord a non-exclusive licence to use, reproduce, adapt and process that material to the extent reasonably necessary to create, produce and deliver the requested products, administer your order and address related customer service issues.

This licence does not transfer ownership of your original photographs to Sasha Nord.

We may decline to use material where we reasonably believe its use would be unlawful or infringe third-party rights. Where this affects an existing order, we will communicate with you and comply with applicable refund and consumer protection requirements.

7. Intellectual Property and Artwork Ownership

Unless otherwise agreed in writing, Sasha Nord retains the intellectual property rights it owns in its original artwork, illustrations, designs, branding, product photography, website content and other creative materials.

Purchasing a physical artwork or personalised portrait does not automatically transfer copyright in the underlying artistic creation.

Customers purchasing Sasha Nord artwork receive the right to use and display their purchased physical products for personal, non-commercial purposes.

Where a digital artwork file is expressly supplied as part of an order, the customer receives a personal, non-exclusive, non-transferable licence to use that file for private, non-commercial purposes, unless different licensing terms are expressly provided.

Without prior written permission, customers may not commercially reproduce, distribute, sell, license or exploit Sasha Nord's copyrighted artwork.

These terms do not restrict rights arising under applicable copyright law or rights that customers retain in their own submitted material.

8. Portfolio, Advertising and Marketing Permission

Sasha Nord may wish to feature completed artworks and customer-submitted photographs in its portfolio, website, social media accounts, advertisements or other promotional materials.

We will request separate, explicit and voluntary permission before using customer-submitted photographs or identifiable customer-related material for promotional purposes.

Where consent is the applicable legal basis for promotional use, we will explain what material we wish to use and the intended purposes before requesting permission.

Customers may choose whether to authorise the use of:

• Their completed personalised artwork.

• Their original submitted photographs.

• Both categories of material.

Customers may decline marketing permission without affecting their ability to purchase products or receive the services ordered.

Consent to processing personal data for marketing may be withdrawn at any time by contacting sashanordco@gmail.com.

Following withdrawal, we will stop the relevant consent-based use and take appropriate steps regarding material under our control, subject to applicable legal obligations and limitations.

Withdrawal does not affect processing lawfully carried out before consent was withdrawn.

Permission for promotional use does not transfer ownership of customer photographs or grant Sasha Nord rights beyond the scope expressly authorised.

9. Prices, Currency and Payment

Product prices are displayed in the currency applicable to the customer's selected store or market.

Prices, discounts and promotions may vary between countries due to currency conversion, production costs, taxation and other market-specific factors.

Any applicable shipping charges and taxes collected at checkout will be displayed before the customer completes the purchase.

Where import duties, customs charges or taxes may be payable upon delivery, we will provide the relevant information before purchase as required by applicable law.

Payments are processed through the payment methods made available at checkout.

Sasha Nord does not guarantee that every payment method is available in every country.

An order must be paid in accordance with the payment terms displayed at checkout.

We reserve the right to correct pricing errors, provided that confirmed customer orders are handled in accordance with applicable contract and consumer law.

10. Shipping and Delivery

Sasha Nord serves customers in Norway and selected international markets.

Shipping methods, delivery areas, production locations and estimated delivery times may vary depending on the product and destination.

Certain products may be created and shipped directly by selected production or fulfilment partners.

Any applicable delivery charges and relevant delivery information will be communicated before checkout.

Estimated delivery times are not guarantees unless expressly agreed as binding.

We will notify customers of material delays where required and provide the remedies available under applicable consumer law.

Risk of loss or damage generally passes to consumer customers when they, or a third party designated by them other than the carrier, take physical possession of the goods, subject to applicable legal exceptions.

11. Cancellations, Returns and Refunds

Personalised goods made to a customer's individual specifications may be exempt from the ordinary statutory right of withdrawal where permitted by applicable law.

For Sasha Nord personalised portraits, customers may request cancellation before artwork production has begun.

Once production begins, voluntary cancellation may no longer be available.

Non-personalised products may qualify for statutory withdrawal rights, including the applicable 14-day withdrawal period under Norwegian and relevant European consumer law.

Customers retain their statutory rights where products are defective, damaged, incorrectly supplied or otherwise do not conform to the purchase agreement.

Nothing in these Terms excludes or restricts mandatory consumer rights.

12. Product Quality and Consumer Rights

Sasha Nord is committed to supplying products that conform to their descriptions, agreed specifications and applicable quality requirements.

If a product is defective, damaged or incorrectly supplied, customers may be entitled to repair, replacement, price reduction, cancellation of the purchase, refund or other remedies in accordance with applicable law.

Under Norwegian consumer law, complaints must be submitted within a reasonable time after discovering a defect. A complaint made within two months after discovery is always timely.

The general statutory complaint period is two years from delivery, extending to five years for goods or components intended to last substantially longer under normal use.

Additional or different mandatory consumer protections may apply in a customer's country of residence.

Commercial policies regarding artwork satisfaction, voluntary returns or customer preferences do not replace statutory remedies.

13. International Purchases

Sasha Nord operates from Norway and may offer products in selected international markets.

Product availability, shipping arrangements, taxes, payment methods and fulfilment locations may differ depending on the destination country.

Customers are responsible for ensuring that their shipping information is accurate.

Any customer responsibility for import-related fees will be disclosed as required by applicable law before purchase.

We reserve the right to restrict sales or deliveries to destinations that we cannot lawfully or reasonably serve.

Such restrictions will not remove obligations already arising from confirmed orders or applicable consumer law.

14. Website Use

You agree to use the Sasha Nord website lawfully and in a manner that does not interfere with its operation or the rights of other users.

You may not:

• Use our website for fraudulent or unlawful activities.

• Attempt to gain unauthorised access to website systems or customer information.

• Upload malicious software or harmful content.

• Misuse our intellectual property or reproduce protected content without authorisation.

• Interfere with the website's security or normal operation.

We may take proportionate steps to address unlawful or abusive activity, consistent with applicable law.

15. Third-Party Services

Our online store uses Shopify and may rely on independent service providers for payment processing, website functionality, shipping, production and other operational services.

Certain services may be subject to additional terms provided by their respective operators.

Sasha Nord remains responsible for fulfilling its obligations to customers under the applicable purchase agreement and mandatory consumer law.

The involvement of a third-party service provider does not eliminate those responsibilities.

16. Privacy and Data Protection

Sasha Nord processes personal data in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR) where applicable.

Personal information may be processed for purposes including order fulfilment, payment administration, delivery, customer support, legal compliance and other purposes described in our Privacy Policy.

We handle customer-submitted photographs and personalisation information in accordance with applicable data protection obligations.

Marketing activities requiring consent will be based on valid, specific and freely given permission.

17. Limitation of Liability

Sasha Nord is responsible for its obligations under the purchase agreement and applicable law.

We are not responsible for losses resulting solely from circumstances outside our reasonable control, to the extent permitted by applicable law.

We are not responsible for consequences arising directly from materially inaccurate information supplied by customers where such consequences could not reasonably have been prevented by us.

Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted, including mandatory consumer remedies, applicable product liability or liability for fraud or intentional misconduct.

Any contractual limitation of liability applies only to the extent permitted by the law governing the relevant claim.

18. Events Beyond Our Reasonable Control

Circumstances outside our reasonable control, including significant transport disruptions, natural disasters, major infrastructure failures or government restrictions, may affect our ability to fulfil orders.

If such circumstances materially affect an order, we will inform the customer where reasonably possible.

We will comply with applicable laws concerning delivery delays, cancellation, refunds and other consumer remedies.

19. Changes to These Terms

Sasha Nord may update these Terms of Service to reflect operational, legal or business changes.

Updated terms will be published on our website with a revised effective date.

The terms applicable to a confirmed purchase will generally be those in effect when the purchase agreement was concluded, unless the parties lawfully agree otherwise or a legal requirement applies.

We will not retroactively remove contractual or mandatory consumer rights through changes to these Terms.

20. Governing Law and Dispute Resolution

These Terms of Service are governed by Norwegian law, subject to applicable rules concerning consumer contracts and mandatory protections in other jurisdictions.

For international consumers, this choice of law does not deprive customers of mandatory consumer protections afforded by the law of their country of habitual residence where such protections apply.

If a dispute arises, we encourage customers to contact us first so that we may seek a fair and practical resolution.

Customers may also have the right to contact relevant consumer authorities, alternative dispute resolution bodies or competent courts.

Nothing in these Terms restricts access to legally available dispute resolution procedures or courts, or otherwise limits rights granted by mandatory applicable law.
